Contrary to what you will hear from GNC and GHC,
S683 and H554 would not
“eliminate proactive inspections by every county and municipality in North Carolina”,
or “end Greensboro’s Rental Unit Certificate of Occupancy ordinance.”

The bills absolutely do allow local governments to have proactive inspections
on problem properties.

...Deadlines and fines are the real teeth of Greensboro’s RUCO ordinance,
and we support them.

They added a requirement of 2 or more violations to be able to assess fees.

It is the threat of these fines that probably have been helpful

in reducing the number of substandard housing cases the city has on record.

...the claim that RUCO has “reduced substandard housing in Greensboro by almost 50%”

is not accurate.

Greensboro’s RUCO program involves inspecting every single rental unit in the city.

After 7 years we now know that about 90% of them have passed with flying colors,

while, sadly, the 10% that are problem properties still have problems.

RUCO’s universal inspection approach has actually delayed cleanup of the city’s housing,

wasting time and money on the other 90% - including even luxury apartments.

The bills would absolutely allow the city to target proactive inspections

on fixing the problems and fine the bad actors.

As a manager of rental housing in Greensboro,

I have tried to support RUCO for years, but the program

has been fraught with problems since its inception.

You have the opportunity to help make rental housing safer and more affordable in Greensboro,

and save Greensboro tax payers millions in tax dollars.

...After 7 years we now know that Greensboro spent nearly $3 million inspecting about 35,000 rental units,

but STILL has problem properties in the city.

...one City Inspector told me in confidence that he knew the program was not effective,

and that he had opposed it within his department.

The vast majority, almost 90%, of rental units properties passed with flying colors,

and more than one third of the violations were caused by tenants.

...because this “universal” inspection approach is overly ambitious and unwieldy,

bureaucratic inefficiencies took even more focus off the real work to be done

- improving the 10 percent of housing that is substandard.

The current RUCO program has had problems like reinspections of good properties

that have to be done solely because the city lost the RUCO records;

enforcement mistakes like neglecting to enforce the “repeat offender” portion of the ordinance;

staff making a fine 12 times higher after the appeal period ran out;

scheduling inspections on exempt properties;

and inconsistent interpretation of the ordinance and the maintenance code.

Not only has this wasted tax dollars,

but Landlords have also wasted tremendous sums of money dealing with red tape

and unnecessary inspections – real money that pushes up real rent rates.

We want safe and affordable housing in Greensboro,

and today is your opportunity to make a step toward that!

Proposed legal theft of taxpayer money; "developers want $8 million in taxpayer money from City of Greensboro"

"Developers of a proposed downtown Wyndham luxury hotel are asking the City Council for more than $8 million to help build it and a parking deck.

What will the other hotel's planned for downtown ask for

if these folks get more than $8 million?

 

If there are three planned hotels,

$24 million?

Elm Street Center Hotel has asked for a $1.35 million incentive grant.

The group of local and Washington D.C.-based investors also asked the city to lease a parking deck that they will build as part of the project. Under the original proposal, the city would pay up to $7.1 million to lease the parking deck over 25 years — and essentially help reduce the developers’ costs.

Investors expect the $40 million hotel to create 168 jobs.

How much would this taxpayer subsidized project hurt the Greensboro Marriott,

a competing private business that didn't take everyone else's money?

“A project like this luxury hotel for downtown Greensboro isn’t going to happen without participation from local government,” Mayor Robbie Perkins said. “You have to keep in mind this is a $40 million luxury hotel. It’s a big deal.”

Robbie Perkins received campaign contributions

from Randall and Tobee Kaplan in the last election cycle.

 

If the GPAC wasn't being built,

the hotel proposal wouldn't be viable.

 

Kathy Manning, Randall's wife who contributed to Nancy Hoffmann,

led the fundraising campaign for the GPAC

which will cost taxpayers more than $50 million.

News & Record Letter to the Editor; David Hagan’s commissions don’t serve taxpayers

"On Sept. 3, and again on Sept. 17, Robbie Perkins and Nancy Vaughan knowingly voted to give fellow Greensboro Country Club member David Hagan, who serves on the Community Foundation’s board, about $586,000 in commissions for purchasing performing arts center properties.

The city of Greensboro has four real-estate brokers who could have purchased the properties for no more than their salaries.

I believe Perkins, Vaughan and the Community Foundation’s Walker Sanders, who was involved in the negotiations, did not act in the best interests of Greensboro’s taxpayers concerning these real-estate transactions.

I call for David Hagan, who is U.S. Sen. Kay Hagan’s brother-in-law, to forfeit his commissions."

GPAC Bait and Switch; The unpurchased GPAC properties that may cost more, now that City Council voted to buy the others

These are the additional properties yet to purchase, which also wasn't reported until last Tuesday's Council meeting.

I hear there were contracts from December that expired, and now the properties will cost even more.

Walker Sanders, by not having all the agreements in place, may well have cost the city quite a bit more money.

Clearly deceptive tactics on the part of the task force, city council and City of Greensboro staff.

Bait and Switch

First, taxpayers were "baited" by being told the City of Greensboro was buying $7.6 million of real estate for a $60 million GPAC, with announcements of two new hotels during Wyndham week when negative news is relatively prohibited by local main stream media.

Second, on the eve of the council vote, the discovery of more properties to purchase becomes known, on top of what was on the agenda.

The goal of the bait-and-switch in this case was to persuade the public to favor the switch as a means of avoiding disappointment over not getting the performing arts center and hotels, and for the city to spend more money without the public really knowing what was actually happening.

This suggests that city staff, city council and the News & Record Editorial Board didn't want to transparently inform, but instead bait the public with the wonderfulness of the project without disclosing important details like the bogus financing math presented.

No binding commitments and no letter of Credit

Kathy Manning, Randall Kaplan's wife, lobbying for a GPAC and their new hotel

City Council voted to finance $10 million for GPAC based on a projection that every performance will sell out all 250 premium parking spaces to pay for the debt service.

Please provide the "binding commitments for a minimum of $20,000,000.00 in private contributions for the GPAC.

Instead of using 149 events to calculate the income to pay off the bonds that the hired consultant predicted, city staff and council raised the number of events to 180 per year, with all 250 premium parking spaces sold out at each and every show, even though there will be plenty of free and much lower cost parking options in close proximity to the venue.

This is flat out bogus math, which means the City Council members who voted for it broke their fiduciary duties to Greensboro's taxpayers.

Bait-and-switch; like when I sold above ground aluminum swimming pools in 1992.

When I arrived in Greensboro, I was trained to present a bait and switch one call close sales presentation to sell swimming pools.

I got two leads a day, and would drive anywhere from Blacksburg, Virginia to Rock Hill, South Carolina to make sales calls.

Told the marks I was a "manager", on my way to set up a demonstration pool in the next town.

The bait was a $999 pool advertised in TV guides, and I would downplay the quality of the advertised pool, and switch to a $13,900 pool in the presentation, took a little off the top if they wanted the "demonstration" deal, under which they agreed to write a letter of recommendation etc..., reduced the big number to an affordable monthly payment of $249, (reduction to absurdity) and pop a second mortgage on the home at least a 17% annual interest rate.

I made half of any deal over $7,200.

I have been telling this story among others in Financial Ethics classes for years, as an example of how to not get ripped off by some of who I used to be.

The GPAC promotion and propaganda has been the same thing only different.

Zack Matheny Speaks About Simkins PAC “Promise”; Posted by ryan [Shell] on January 15, 2008

"I had a quick face-to-face meeting with Zack Matheny yesterday afternoon which allowed us to talk about everything from jobs to Greensboro politics.

One of the politics questions I asked Matheny had to do with an anonymous letter that referenced a promise everyone indorsed by the Simkins PAC had to make in order to receive the PAC endorsement. The letter said the following,

“The Simkins PAC board members required a promise not to fire Mitch Johnson and to support the civil rights museum in order to receive their endorsement (emphasis mine)… Newcomer Zack Matheny is being coached by Perkins and Wells on how to vote after they get their orders from Jim Melvin.”

My question to Matheny was pretty simple, “Did you make any type of promise to the PAC that Johnson would not be fired and that you would take action to financially help the civil rights museum?”

Without taking anytime to mull over the question he responded by saying “There is no validity to that whatsoever!”

I believe Yvonne Johnson should have been recused from deliberations and voting on the Civil Rights Museum issue

If Robbie Perkins was excused for living in a building and having money passed through to Roy Carroll, Yvonne should have been excused for belonging to a PAC with Skip Alston which paid Skip's kin and possibly Yvonne's, and for being listed as a manager of one of the Civil Rights Museum's legal entities.

Mayor Robbie Perkins, whose 2011 campaign paid $3,000 for the Simkins PAC endorsement, was the honorary chairman of a recent ICRCM/Simkins golf tournament. Mr. Perkins is now advocating Greensboro taxpayer money be spent to save the museum, which would let some Simkins PAC members retain fiduciary control over the museum’s finances.

Compromised Fiduciaries: Conflicts of Interest in Government and Business

These illegitimate interests include self-interest narrowly construed; they also include interests of others with whom the official may feel personal or professional kinship, such as a former colleague, or someone similarly situated to the official or whose favor the official would like to curry. Some of these interests could be characterized as self-interest broadly construed...

The best counterweight to conflicts of interest is a strong commitment to personal and professional responsibility that empowers a business or government decisionmaker to overcome the motivation to advance interests other than those he is supposed to be advancing. Decisionmakers in business and in government should be firmly committed to principles of ethics, not just to obeying narrowly defined rules.

...Councilmember Matheny made a motion that Council commit to $20 million based on funding mechanisms put forth utilizing the City’s portion of the hotel/motel revenues received, as well as, other funds such as user fees and ticket tax, contingent on private donations being brought forth from the taskforce.

Mayor Pro-Tem Johnson seconded the motion.

...City Manager Roth confirmed that funds could possibly be pulled from the General Fund.

...Councilmember Matheny favored using hotel/motel tax funds, user fees and private sector funds; and that the City needed to commit to the project in order to promote and solidify private sector fundraising.

...the City Council will not permit any financing efforts to be completed for the $20,000,000.00 in municipal financing outlined above until the GPAC Task Force is able to confirm that they have obtained binding commitments for a minimum of $20,000,000.00 in private contributions for the GPAC.

"A regulatory reform bill heading for a House vote repeals GS 160A-285(a).  Greensboro residents know that as the protest petition law. 

It's an old provision in state law, but it Greensboro had been mysteriously exempted in 1971. In 2009, with encouragement from local activists [Keith Brown, aka Triad Watch] and legislators, Greensboro was again covered by the law.

Now the law is in danger of disappearing statewide.

The measure allows residents who oppose a rezoning to present a petition to the City Council. With enough support, they can force the council to muster a three-fourths vote to approve the rezoning.

This empowers the people.

Developers don't like it. They are empowered at the General Assembly (see my Durham post from yesterday)."

Tonight, City Council was supposed to vote to give TREBIC’s Marlene Sanford [who fought against Protest Petition] money to lobby on Greensboro's behalf.

TREBIC [who fought against Protest Petition] directs campaign donations.

TREBIC, which is Marlene Sanford, Robbie Perkins, Roy Carroll and others, acted to limit RUCO in 2008.

Robbie Perkins and Marlene [who fought against Protest Petition] stacked the RUCO board and the Minimum Housing Standards Committee

Robbie Perkin's campaign money comes from those who wanted RUCO eliminated.

Mayor Perkins illegally funded TREBIC by deducting his donations which were spent on lobbying, voted to limit rental inspections, and now City Council was asked to fund Marlene with taxpayer money.

TREBIC and Robbie Perkins are responsible for harming poor renters along with other elected officials who didn't lift a finger.

This is what Marlene and Robbie, who served together on the RUCO board which met at TREBIC’s headquarters brought Greensboro with taxpayer money.

Dawn Cheney is on the executive committee for The Greensboro Landlord Association, is on DGI’s board, was on the RUCO taskforce, and is now on the post RUCO study committee.

Mrs. Chaney also chairs Greensboro's Redevelopment Commission and now she’s on the committee to fix DGI.

Those who have harmed poor renters have been left unaccountable for their actions, and continue to pervert our government.

These people are actively harming Greensboro with regulatory capture, self dealing, cronyism and stacked committees and our news industry won't report it."

On March 5, 2013, Abuzuaiter, Hoffmann, Johnson, Kee, Perkins and Vaughan voted to spend Greensboro's taxpayer money to fund the Fire Union's desire to have thier union dues deducted from city paychecks, and Robbie got positive press from Greensboro's paper of record, while failing to mention Robbie threw them some legislated love the month before, or that the Fire Association/Union/PAC makes political endorsements and works voting centers with volunteers on election day.

who then hire the son to work as a federal lobbyist for the City of Greensboro.
