Folks – this process has taken entirely too long.

I am requesting a meeting to be held at City Hall for Monday at City Hall at 10:00 am.

The goal is to get everyone in the same room and finalize this contract.

Sam Simpson is the new DGI board Chairman, and a Zack Matheny contributor, along with some of his business partners.

The building that would have received the benefits of taxpayer money is owned by John Lomax, who I recall gave Zack $1,000, as well as Nancy Hoffmann

Mr. Matheny denied Sam Simpson was going to make any money on the deal on video at city council;

Kathi & Andy,

I appreciate your help on this agreement. I am re-sending the email that explains the concerns that Gerbing’s is re-asserting because it has Andy’s indication that we can work through these items. I believe these issues are still valid, however the language in the last version from the city attorney was not clear. For example, we agreed to the provision that the total compensation would be increased by 20% to $51,600 – however the language now reads 51,600 including 20% fringe, so we did not get around the original issue at hand. I think the city attorney is working to create additional point for the deal structure instead of reflecting the deal structure on which we have all agreed (reflected in the attached resolution and our subsequent conversations).

We are moving the occupancy date to as late as May 2016 due to the delay in construction, obviously they hope to be in sooner, but the construction has been placed on hold until the lease is executed and the contract with the city is finalized.

I have redlined the main concerns that are listed in this email in the attached document. We are open to meeting in person to hammer these issues out once you have reviewed.

Kathi,

After a careful review of the changes Mr. Simpson made to the final version of this contract, I cannot agree to his modifications.

The changes he is asking for, especially his change to the number of jobs created in Greensboro, is a material change to the Resolution approved by Council on August 5th, 2013. I have reviewed the Council video from the meeting several times. 

...In addition, he has inconsistently changed the date, also set by Council, as to when the jobs will need to be created. Again, this constitutes a material change to the terms and will need to be approved by the full Council at a regular meeting...

My involvement began on 10/23/2013. Mike and I met with Andy Scott and Kathi Dubel.

...At that meeting we were told that only “two or three” jobs would come from Stoneville.

...Late yesterday (11/21) Kathi emailed us changes from Sam Simpson. Today I emailed back my opinion, after consulting with you and Mike, that the changes were material changes to the Resolution made by Council on August 5, 2013.
